Lindon Thomas, a Sierra Leonean photographer made his first appearance before Magistrate Santigie Bangura of Pademba Road Court No.2 on high level alleged robbery case on Monday, 19th May, 2025 on three count charges.
The accused was arraigned for robbery with aggravation contrary to section 23 (1) (a) of the Larceny Act 1916 as repealed and replaced by section 2 of Act no 16 of 1971, wounding contrary to section 20 of the Offences Against the Persons Act 1861 and assault occasioning actual bodily harm contrary to section 27 of the Offences Against the Persons Act 1861.
According to the particulars of offence, the accused on Sunday, 16th February, 2025, at Waterloo, in the Western Rural District on Freetown being armed with a syringe, robbed Joseph Thoronka of one motorbike with registration number ASZ 735 valued sixteen thousand leones (NLe16,000), one Techno Pop 2 mobile phone valued two thousand five hundred leones ( NLe2,500) and the sum of five hundred and forty leones (NLe540) all to the total value of Nineteen thousand and forty leones (NLe 19040) at the same time, immediately before such robbery did use personal violence on said Joseph Thoronka.
Count two indicated Lyndon, on the same date and place, maliciously wounded Joseph Thoronka.
Count three furthered that Lyndon on the same date and place, assaulted Joseph Thoronka in a manner thereby occasioning him actual bodily harm.
When the charges were read and put to the accused, no plea was taken.
The Assistant Commissioner of Police Joan M.S Bull led in Prosecution witness number three David Kargbo who said he knew the accused person as his younger brother and recalled on 16th February, 2025, when he went home, but did not meet his brother and enquired about his whereabouts by asking around but nobody could account for his whereabouts.
David mentioned that he took a bike and then went in search for him from park to park at around 2:00 am but to no avail and became worried as he was not in possession of a mobile phone. The witness furthered that he again went in search of him again in the morning hours from park to park asking people if they know him. He said it was at that point they also realized that prosecution witness number one has not been around he then went in search of him again but to no avail.
He revealed that on the third day he secured a phone and placed his SIM in it and then instantly received a called from someone who identified herself as Mammy Isata from Waterloo. He said the woman told him that she has been calling his line but to no avail for two days now and that his brother was in a very critical condition. He said he immediately left for Waterloo after receiving the news and met her and identified himself to her and she took him where his brother was. He said she called out several times, but he did not answer as he was unable to talk and his general condition was really bad.
David furthered that he noticed his face was swollen, feet was swollen, nails black, urinated with blood and was unable to control himself. The witness said when he asked his brother what happened; he told him that a certain “Bad man” took him there. He asked him if he knows the man and answered in the affirmative, stating that he has known the said Bad Man for more than three years now.
He went on to say that he took him to Congo Cross Police Station and later went with him to hospital, he said whilst his brother was in the hospital. He said he, and the police officers arrested the accused who was identified by prosecution witness number one at the station. He later made statement to the police.
The witness was cross examined by T. Foday Musa Esq. and renewed and adopted her previous bail application on behalf of the accused person.
Meanwhile, Magistrate Bangura refused bail because of the seriousness of the offence charged and sent the accused person to the male correctional facility in Freetown and matter adjourned to 26th of May, 2025, for the continuation of his trial.
