Twenty-five- years- old Raymond Kamara, who is a student of Fourah Bay College, University of Sierra Leone, has made another appearance before Magistrate Santigie Bangura of Pademba Road Court No.1 in Freetown.
He is standing on three count charges one for wounding with intent to murder contrary to Section 11 of the Offence Against the Person Act 1861, wounding contrary to Section 20 of the Offences Against the Person Act 1861 and assault occasioning actual bodily harm contrary to Section 47 of the Offences Against the Person Act 1861.
According to the particulars of offence on Sunday 19th May, 2024 at number 1 Conteh Drive and No.2 River village in the Western Rural area in Freetown wounded Ishmail Conteh with intent to murder him.
Count two further stated that the accused on the same date and place maliciously wounded Ishmail Conteh.
Count three further stated that, on the same date and place, the accused assaulted the said complainant in a manner thereby occasioning him actual bodily harm.
When the charges were read and explained to the accused, no plea was taken.
“You are charged with three counts of wounding with Intent to Murder, Contrary to Section 11 of the offences against the Person Act of 1861, wounding, contrary to Section 20 of the Offences against the Person, ” Magistrate Bangura delivered his ruling.
Act of 1861 and assault occasioning actual bodily harm, contrary to Section 47 of the Offences Against the Person Act of 1861.
Being that the charges are indictable in nature, this matter proceeded with a preliminary investigation.
In such a proceeding, it is for the prosecution to adduce sufficient evidence that would establish a prima face case to be answered by the accused on trial if he is to be committed to stand trial at the High Court.
He further stated that in establishing their case against the accused, the prosecution called five witnesses including formal witnesses all of whom testified and were cross-examined.
“I have seen from the evidence that all the prosecution witnesses are consistent on the fact that the accused stabbed the victim herein with one of three objects he was holding which are a knife, a barbecue fork and a scissors.”
“This came after hitting him with a stone. I have also seen the medical report in Exhibit A1-5 confirming the victim complained of before this court.”
He rule that with the piece of evidence so far adduced before him the prosecution have raised a case to be answered by the accused, and is sufficient to commit him to the High Court for trial he therefore committed him to the high court
