Ali Jaffal, Abdul Jaffal, Abdallah Jaffal, Mohamed Jaffal, Abass Antar, Naif Antar and Hassan Jaffal made another appearance before Magistrate Santigie Bangura of the Pademba Road Court No.2 for allegedly wounding one Adam Hamdam.
The accused are standing trial on seven count charges ranging from wounding, assault, affray, throwing missiles and disorderly behaviour.
The indictment states that the accused on Saturday, 6th April, 2024 at the Young Sports Club (YSC) facility at Wilkinson Road in Freetown, maliciously wounded Adam Hamdan and Mohamed Aroune. The charge sheet also stated that the accused behaved in disorderly manner as they assaulted Adam Hamdan and Mohamed Aroune in a fight with intent to put the public into fear by throwing stones, sticks and other missiles.
On their first appearance, the charges were read and explained to the accused but no plea taken.
After the prosecutor has led their witness and the defense counsels submitted their no case submission the file was withdrawn for judgment.
In his judgement, Magistrate Bangura found the 1st, 2nd, 3rd, 4th, 5th and 7th accused guilty and discharged the 6th accused.
The state prosecutor Yusuf Isaac Sesay in reply to the no case submission, said
he was confused about the certainty of the no case submission from the defendants’ counsel. He said the accused were separately represented but made a joint no case submission at the end. He said he relied on the statements of the six accused made. He also drew the attention of the magistrate to the testimony of Prosecution’s witnesses number 1, 2 and 3 and the confessional statements by the accused there is sufficient evidence against the accused.
The accused were represented by the Bar Association President Tuma A Jabbie.
Meanwhile, Magistrate Bangura adjourned the matter to 12th March, 2025 to deliver his judgment.
