The State prosecutor Yusif Isaac Sesay Esq yesterday made an application for Disposal of drugs before Justice Alhaji Momoh Jah Stevens at the high Court No.1 in Freetown he further that it is an application by way Ex-parte the originating notice of motion dated 26th February 2025 for the orders prayed for on the face of the motion.
He said In support of the motion is an affidavit in support deposed by Alpha Jalloh a state counsel at the Law officers department sworn on the 26th February 2025 attached to this affidavit in support there are eight exhibit attached
Yusif Isaac Sesay Esq indicated the exhibit attached as follows
Exhibit AJ1 is a letter from the Head of the Transnational organised crime unit TOCU requesting for court order for the public destruction of drugs
Exhibit AJ2 is the list of the particular matters that are being investigated of the said drugs
Exhibit AJ3 is a letter from the executive Director of the National Drug Control agency requesting for the destruction of the illegal Drugs
Exhibit AJ4 is a case and inquiry file with CR number 482/2024
Exhibit AJ5 are laboratory analysis reports of liquid substance suspected to be liquid substance Pharmaceutical drugs, Kush cocaine and other dangerous drugs
Exhibit AJ6 is the case and inquiry file with CR number 507/2024 containing Parcels of cocaine
Exhibit AJ7 is a laboratory analysis report suspected to be cocaine Exhibit AJ8 is also laboratory analysis report of white substance suspected to be cocaine, Tramadol and kush
He told the judge that relied on the entity of the affidavit in support
Justice Stevens delivered his Ruling he said these drugs is destroying the future of our youth he then grants the undermentioned orders with the sole aim to destroy a huge quantity of these drugs in other that same will not fall in the hands of the wrong persons
He then Ordered as follows
1- This Honourable Court grants an order and supervise the public disposal of drugs (that is Tramadol, cocaine, kush and other pharmaceutical Drugs) that are in the custody of TOCU pursuant to Section 47(2) and (3) of the National Control Drugs Act 2008 Act No. 10 of 2008 though the matters are pending before the Magistrate Court
2- This Honourable Court orders the destruction of substantial portion of all exhibits in the case and enquiry file that C/R NO.447/2024, C/R NO. 482/2024, C/R NO. 502/2024, C/R NO.
507/2024, C/R NO. 378/2024 and C/R NO. 03/2024.
3- This Honourable Court grants an order for the preservation of 2 grams of each exhibit for the due administration of justice.
4- This Court orders that the 2 grams of these preserved must be destroyed at the end of the trial.
