Ishmail Nabieu a mason and Balla Marrah a carpenter made their first appearance before Magistrate Santigie Bangura of Pademba Road Court No.2 in Freetown on four count charges to wit conspiracy to commit a felony contrary to law, wounding with intent, wounding and assault occasioning actual bodily harm contrary to section 47 of the Offences against the Persons Act of 1861.
According to the particulars of offence, on Wednesday 16th April, 2025 at Black Tank Adonkia, Goderich in the western area of Freetown conspired together with other persons unknown to commit a felony to wit wounding with intent.
Count two further stated that on the same date and place, the accused persons wounded Baimaro Sesay with intent to cause him grievous bodily harm. In count three and four, on the same date and place the accused persons maliciously wounded and assaulted Baimaro Sesay in a manner thereby occasioning him actual bodily harm.
When the charges were read and explained to the accused persons, no plea was taken.
Assistant Commissioner of Police Juan M. S. Bull led prosecution witness number one Baimaro Sesay a businessman, recognized both accused persons on the day of the incident. He recalled on 16th April, 2025 something transpired between himself and the accused persons at around 10:00 am. He told the court that on the day in question, he went to his cousin Abass Sesay at Black Tank, Adonkia who told him to supervisor Money Gram office for him. According to his cousin he has been in possession of the property for years. The witness said he met a certain person named Sanjai who told him that he marked the shop because he will ensure that he will set it ablaze all the zinc houses. The witness said the said Sanjai said this because he received a court order after that the first accused took a stone and hit him on his side and kicked him and joined the second accused who took a stick and started hurting him and whilst they were beating him, they told him they were brought specifically for him because he has been proven to be stubborn. The witness added that later another unknown person armed with machete joined them. The witness furthered that people were around but afraid to interfere because they were armed. He further told the court he experienced severe body pains and wounds on his left hand and that nobody was able to rescue him. He said he fought had and escaped from his captors who chased him. The witness said he ran straight to the street and the accused gave up their chase. He said he went to Adonkia police station where he made report and he was issued police medical request form which he took to Lumley hospital where he was examined and treated and returned the endorsed medical request to the police station where statement was obtained from him and the police medical request form was produced for identification and marked as exhibit Z.
The witness was cross examined by Charles Abass Bangura Esq. who applied for bail for and on behalf of the both accused persons.
Meanwhile, Magistrate Bangura refused bail for the second accused based on the seriousness of the offences charged and bail continue for the first accused person and matter adjourned to the 15th May, 2025.
