John Kainessie, who is unemployed, and Yusif Kamara, a student and Sheku Sheriff a builder, have made their first appearance before Magistrate Santigie Bangura of Pademba Road Court No.2 in Freetown. They are interrogated for on three count charges to wit office breaking as contrary to Section 26 (1) of the Larceny Act 1916.
And on count two, they are held for committing larceny on ranging from receiving stolen goods contrary to Section 33 (1) of the Larceny Act 1916.
According to the particulars of offence on Sunday 28th April 2024 at 9 I.B Garage Drive, New York in the Western Area in Freetown with intent to steal, the accused broke and entered the office of Augustine Sesay and stole therein two rolls of siphon uniform, one elemax generator 2.5 KVA, ten dozen assorted exercises books, assorted text books, fifteen hand sanitizers, eight computer monitors and other assorted items equivalent to the total value of sixty five thousand one hundred and eighty Leones(65,180,00).
They are property of the said Augustine Sesay and on count two on the same date and place the second accused did receive assorted exercises books valued at eight thousand four hundred Leones(8,400,00) knowing same to have been stolen as property of Augustine Sesay. And on counts two on the same date and place the third accused did receive one computer monitor valued at eight hundred Leones(800,00) knowing same to have been stolen property of Augustine Sesay.
When the charge was read and explained to the accused no plea was taken, the prosecutor, Deputy Superintendent of Police Sorie Conteh, sought for a short adjournment date for him to get proper conference with his witness.
Counsel representing the third accused M.S Sankoh and C.H Gogra applied for the bail on behalf of the accused saying that he is a Sierra Leonean and resident within this jurisdiction. And that he has reliable sureties who are willing and ready to go into recognizance on his behalf and he would not interfere with prosecution witness or witnesses nor would he jump bail. He made his application pursuant to Section 79 2 of the Criminal Procedure Act No.32 of 1965.
Meanwhile, Magistrate Bangura granted the third accused bail in the sum of three hundred thousand Leones with one surety in like sum and surety to produce valid identity card depicting his or her address in Freetown.
The bail was to be approved by the court whilst the first and second accused persons were sent to the Male Correctional facility in Freetown.
The matter was adjourned till 6th June 2024.
