Eighteen-years-old, Musa Kamara, a footballer made another appearance before Magistrate Santigie Bangura of Pademba Road Court No. 2 in Freetown.
He stood on three count charges for conspiracy to commit a felony contrary to law, robbery with aggravation contrary to Section 23 (1) (a) of the Larceny Act 1916 as repealed and replaced by Section 1 of the Death Penalty Act 2021 Act No.6 of 2022 and assault, occasioning actual bodily harm contrary to Section 47 of the Offences Against the Person Act 1861.
According to the particulars of offence on Sunday 7th July 2024 at No. 7 Bush Water Road Kossoh Town, Waterloo in the Western Rural Area in Freetown, they conspired together with other persons unknown to commit a crime of felony to robbery with aggravation.
Count two further stated that on the above date and place the accused being armed with matches robbed Moinia Kallon of one L.G Home theater, one Dell computer, two silver chain, one black pack bag and other assorted items equivalent to the total value of two hundred and thirty thousand five hundred Leones (230,500) Property of the said Moinia Kallon.
Count three further stated that on the above date and place the accused assaulted the said Moinia Kallon in a manner thereby occasioning him actual bodily harm.
When the charge was read and explained to the accused, no was plea taken.
Sergeant 9155 Dwight McCarthy led in prosecution witness number one DPC 15236 Abubakar Turay attached to the Anti-Robbery Unit at the regional headquarters east Ross Road Police Station he recognized the accused in the dock and the complainant in this matter he recalled on the 11th July 2024 he was on duty at the said office when a transferred case of robbery with aggravation was assigned to him for further investigation the witness said the file contained an endorsed medical report, a search warrant, 19 leaves of photographs statement of the complainant, two witnesses and two other interview statements the said statements was produced and tendered in court to form part of the court records on the 12th July 2024 himself together with DPC 19532 Munu obtained voluntary cautioned statement from the accused in Krio language which was recorded in English language at the conclusion of the statement it was read over and explained to the accused in Krio language which he admitted it to be true and correct by afflicting his right hand thumbprint witness by DPC 19532 Munu and he signed as the recorder the voluntary caution statement of the accused was produced and tendered in court to form part of the court records marked as exhibit G1-7
On the 19th July 2024 himself together with the said investigator charged the accused with the offence he is standing trial on the charge statement was produce and tendered in court to form part of the court records marked as exhibit H1-2 he concluded.
The accused was not legally represented and he cross examined the witness.
Magistrate Bangura refused bail and sent the accused to the male correctional facility in Freetown.
The matter was adjourned to the 22nd August 2024.
