Thirty-nine-years-old Joseph Abdulai Kamara, a businessman and thirty-two- years-old Abdulraham Kamara, a bike rider made another appearance before Magistrate Santigie Bangura of Pademba Road Court No.2 in Freetown on three count charges to wit conspiracy to commit a felony contrary to law and two count ranging from Larceny contrary to Section 2 of the Larceny Act 1916 and Malicious Damage contrary to Section 4 of the Malicious Damage Act 1861.
According to the particulars of offence on Monday 26th September 2022 at Waterloo in the Western Rural Area in Freetown conspired together with Abdulraham Kamara alias Escoba Issah and other persons unknown to steal a Toyota Land Cruiser ambulance vehicle with registration number 70SL79 valued three million three hundred thousand Leones(3,3000,000) as property of the Sierra Leone Armed Forces whilst in custody of Colonel Stephen Sevalie.
On count two the second accused did steal one Toyota Land Cruiser ambulance vehicle with registration number 70SL79 valued three million three hundred thousand Leones(3,3000,000) as property of the Sierra Leone Armed Forces whilst in custody of Colonel Stephen Sevalie.
On count three the second accused on the above date and place did steal one Toyota Land Cruiser ambulance vehicle with registration number 70SL79 value three million three hundred thousand Leones(3,3000,000) property of the Sierra Leone military whilst in custody of Colonel Stephen Sevalie.
On count four on the above date and place the second accused on the above date and place maliciously damaged one Toyota Land Cruiser ambulance vehicle with registration number 70SL79 valued three million three hundred thousand Leones(3,3000,000) as property of the Sierra Leone Armed Forces. Whilst in custody of Colonel Stephen Sevalie Deputy Superintendent of police Sorie Conteh lead Prosecution witness number three Sergeant 9715 Augustine Robert Lansana attached at the Major Lncident Unit at the Criminal Investigation Department (CID) Headquarters at Pademba Road Freetown was the investigator and he recognized the complainant and accused in this matter he recalled on the 28th September 2022 whilst on duty at the said officer Major Mamoud Papa Conteh reported a matter of conspiracy, larceny and Malicious Damage against the accused the matter was allocated to him for investigation he obtained statements from the complainant and witnesses separately.
On the 25th December 2022 a team of Detective Police officers headed by Inspector Jusu, and officer Dpc 13374 Bockarie M visited the scene of crime at lower corner Waterloo when prince Kamara the receiver told them that that was the compound they brought the scrap military ambulance vehicle from the first accused.
On the 9th November 2023 he was informed that the first accused was in the custody for another offence at the Criminal Investigation Department (CID) ‘s headquarters Pademba Road Freetown.
The witness said himself together with DPC 13374 Bockarie M. obtained voluntary caution statement from the first accused in krio language which was recorded in English language at the conclusion of the statement it was read over and explained to the accused in krio language which he admitted it to be true and correct by afflicting his right hand thumbprint witness by DPC 13374 Bockarie M and he signed as the recorder the said statement was produced and tendered in court to form part of the court records as exhibit A1-21.
On the 12th November 2023 he together with the said investigator charged the first accused with the offences of conspiracy, Larceny and Malicious damage the charge statement of the first accused was produced and tendered in court to form part of the court records as exhibit B1-3.
On the 25th December 2023 he got intelligent that the second accused was at Waterloo police station for another offence and the second accused was brought to the Criminal Investigation Department CID headquarters Pademba Road Freetown. He together with the said investigator obtained voluntary caution statement from the second accused in krio language which was recorded in English language at the conclusion of the statement it was read over and explained to the accused in krio language which he admitted it to be true and correct by afflicting his right hand thumbprint witness by DPC 13374 Bockarie M and he signed as the recorder the statement was produced and tendered in court to form part of the court records
On the 8th January 2024, he charged the second accused with the offence of conspiracy, Larceny and Malicious damage the charge statement of the second accused was produced and tendered in court to form part of the court records.
The accused was not represented by legal counsel.
Meanwhile, Magistrate Bangura refused bail and sent the accused to the Male Correctional facility in Freetown and the matter was adjourned to the 3rd June 2024.
