Christiana Foday, Tenneh Foday, Estella Foday and Patrick Foday made their first appearance before Magistrate Hadiru K Daboh of Ross Road Court No.3 in Freetown on a private criminal summon on four count charges to wit trespass, malicious damage, threatening to kill and conspiracy to commit larceny.
According to the particulars of offence on the accused persons on the 14th January, 2023 at around 4pm at Campbell Street, Wellington, unlawfully entered into the compound of Sebatu Mustapha in an annoying approach and on count two on the same date and place maliciously damage the toilet seat and septic pipe valued at three million Leones being properties of the said complainant while count three states that the accused on the same date and place threatened to kill the said complainant and on count four the accused persons conspired together to steal the sum of NLe5,000 (Five million old Leones) belonging to the said complainant.
The charges were read and explained to the accused persons and they pleaded not guilty.
A.O Gbla and M.A Conteh applied for bail on behalf of the accused persons that they are Sierra Leonean residents within the jurisdiction and that they have credible and reliable sureties who are willing and ready to go into recognizance on their behalf, adding that they will not interfere with prosecution witness or witnesses. He made his application pursuant to section 79 (2) of the criminal procedure act No.32 of 1965
Main while Magistrate Daboh granted all four accused persons bail in the sum of one hundred million Leones or two sureties each and sureties to be resident in Freetown. He said the sureties must be gainfully employed and should produce valid identity card depicting his or her address in Freetown and bail to be approved by the Deputy assistant Registrar.
The matter was adjourned to 7th February 2023.
