Principal Magistrate at the Pademba road Court No.1 Magistrate Mark N’gegba has granted bail to 38yrs old Musa Kabia a businessman who deals in used cars.
Musa Kabia on Monday made his first appearance before Magistrate Mark Ngegba on three count charges to wit Larceny contrary to section 2 of the Larceny Act 1916, Forgery contrary to section 2 (1) (a) of the Forgery Act 1931 and altering Forged document contrary to section 6 (1) (2) of the Forgery Act 1913
According to the particulars of offence on a date between the month of November 2018 at No.15 Battery street Kingtom in the Western Area in Freetown did steal by trick one brown Nissan Pathfinder Jeep with registration number AHI 591 valued six thousand United States Dollars (US$6,000) equivalent to the sum of One Hundred and Eighty thousand New Leones (Le180, 000) being Property of Emmanuel Adeyemi Rhodrick Strasser King.
On count two the accused on Friday 9th December 2022 at the Criminal Investigation Department (CID) Headquarters on Pademba Road Freetown with intent to defraud Forged certain document to wit one payment receipt purported to have been prepared and signed by the said complainant knowing same to be false.
On count three of the same date and place the accused person with intent to defraud Forged certain document to wit payment receipt dated 8th January 2019 in the name of the said complainant knowing same to be forged.
The charges were read and explained to the accused Musa Kabia and no plea taken.
The Prosecutor Sergeant I.S Bangura 8975 informed the bench that his witness was absent and therefore sought for a short adjournment date.
Counsel representing the accused K. Williams applied for bail for and on behalf of the accused praying that the accused is a Sierra Leonean resident within the jurisdiction of Freetown and has reliable sureties who are willing and ready to go into recognizance on his behalf, adding that the accused will make himself available on every adjournment date.
He made his application pursuant to section 79 (2) of the Criminal procedure Act No.32 of 1965. Magistrate Mark N’gegba granted bail to the accused in the sum of Three Hundred thousand New Leones (Le 300,000) with two sureties in like sum and sureties to be resident in the Western Area and must produce valid identity card and bail to be approved by the Master and Registrar.
The matter was adjourned to 25th January 2023.
