Moses Marah and Kadijatu Marah who were arrested on 29th October 2022 by Detective Police Constable (DPC) 14109 Sesay I.J made their first appearance before Magistrate Sahr Keikura of the Pademba Road Court No.1 in Freetown for allegedly assaulting and wounding the complainant, Mary Moris Turay in a manner thereby causing her grievous bodily harm.
Moses Marah, 31yrs old and Kadijatu Marah 16yrs old appeared before Magistrate Sahr Keikura on two counts charges of assault occasioning actual bodily harm contrary to section 47 of the Offenses against the Person’s Act of 1861 and wounding contrary to section 20 of the Offenses against the Person’s Act of 1861.
It was alleged by the police that the accused, on August 2022 at No. 23 Queen Elizabeth Road Kissy Dock-Yard in Freetown, assaulted and wounded the complainant thereby causing her grievous bodily harm.
Led in evidence by Assistant Superintendent of Police (ASP), Osman M. Bangura, Prosecution witness (PW) 1, Mary Moris Turay, who resides at No. 23 Queen Elizabeth Road at Kissy Dock-Yard, Freetown, told the court that she recognized the accused and could recalled the day in question.
According to the police file, on Monday 29th August 2022 at around 13:45 hours, she reported a case of assault to the Criminal Investigations Department (CID) Ross Road Police Station, Habour Division in Freetown.
PW1 told the Bench that she and the accused have not been in speaking term.
It was against this backdrop that the police prosecutor ASP Osman M. Bangura, sought for a short adjournment for further examination in chief and, the application was granted.
Responding the first accused was remanded at the Male Correctional Centre on Pademba Road in Freetown while the second was taken to the juvenile home.
The matter was adjourned to 22nd February 2023.
