Joseph Dumbuya and Ahmed Turay on Thursday 29th May, 2025 made another appearance before Magistrate Patrick Fofanah of Pademba Road Court No.1 as they were alleged of conspiring with unknown persons to overthrow the government of Sierra Leone by unlawful means.
Before the commencement of the matter, state prosecutor Yusuf Isaac Sesay said the prosecution filed a consent documents to prosecute the accused done by the Attorney General and Minister of Justice.
He said the consent was done pursuant to section 1(2) of the Treason and State Offense Act No.10 of 1963 as amended.
Led in evidence by state counsel Yusuf Isaac Sesay, the prosecution witness number one Gibrilla Kanu said he is a police officer attached to the Operations Support Division Kingharman Road in Freetown.
He recognized both accused persons in the dock and recalled 26 November 2023.
He said on that day in the morning hours, he had a call from his boss Joe Kamanda Bonjay instructing him and other police officers to onboard a vehicle saying that the Pademba Road Prison was attacked.
He furthered that they onboard a vehicle and drove to police headquarters at George Street where other officers joined them and they left for Pademba Road Prison.
Witness Kanu said upon arrival at Pademba Road by Campbell Street junction, armed assailants opened fire on them.
He said they were instructed to come down the vehicle which they did holding their rifles.
He said the unknown men ordered them to put their weapons down but they resisted and one of the unknown men were holding RPG threatening to fire them if they do not put down their weapons.
He said they decided to spring forward and the unknown men collected their weapons from them.
He said that at that point, he heard the voice of Amadu Koita instructing them to stay one side and ask Colonel Senesie to address them.
Witness Kanu said Senesie asked them how much they are receiving as salary but they did not answer him.
He continued that Senesie also asked them if they are having good medical facility and if their children are going to good schools but said they still did not answer him and he asked them to join the assailants to clean the city.
He said they were ordered to enter the prison which they did and the assailants who were standing outside the prison gate went closer to them and he saw the first accused Joseph Dumbuya wearing white shirt holding AK-47 weapon.
He said Koita ordered them to free the prisoners as time was running out.
He furthered that they entered inside the prison and the assailants were breaking the prison gates asking the inmates to come outside but they were afraid but calmed them not be afraid.
He said during that time most of them hide behind the inmates until they escaped.
Another witness Saidu Kamara also said he is a police officer attached to the said unit.
He recognized both accused persons in the dock and recalled 26 November 2023.
He said on that day, he was at Jui with his boss Joe Kamanda Bonjay, Assistant Commissioner of Police.
He said a called was received instructing them to go to the Pademba Road Prison.
His testimony corroborated with that of the first witness.
The third prosecution Sergeant 8974 Solomon Amadu said he is attached to the Criminal Investigations Department headquarters and he recognized both accused persons in the dock.
He said on 2 April, 2025 he was on duty when the first accused Joseph Dumbuya was arrested and brought to the station on the allegation of treason and other related offenses.
He said himself and Sergeant 1818 Combay Hassan A.S interviewed the first accused Joseph Dumbuya by observing the judges rules.
