Mohamed Jagitay made another appearance before Justice Adrian Fisher at High Court No.1 Siaka Steven street Freetown on a count charge to wit Murder contrary to section 1 of the offences Against the Person Act 1861 as repealed and replaced by Section 1 ( a) to the schedule of the Abolition of the death penalty Act 2022 Act No.6 of 2022.
According to the particulars of offence on the 28th July 2023 in Freetown murdered Ibrahim Jagitay
When the charge was read and explained to the accused person, no plea taken.
The State prosecutor Musa Pious Sesay Jr Esq Led in Prosecution witness number three DPC 15182 Lahai Stevens attached to the Criminal Investigation Department Waterloo police station as an investigator for the past twelve years he has been a Detective on the 28th July 2023 whilst on duty at the said station one Ibrahim Kargbo the head man informed them that they discovered unidentifiable coups at Kelly Farm Waterloo Upon the information himself together with Dpc 17987 Momoh D.K, Inspector A.J Smith and other police officer went to the crime scene upon their arrival they discovered a coups lying on the ground with multiple wounds on various part on his body he also observed that there was a kitchen knife separated from his handle and one white empty airpod pouch the the scene of crime officer took photographs of the scene and they collected the coups of the deceased and the exhibit and he convey the deceased coups to Waterloo mortuary the witness said whilst at the scene he ask Mr Ibrahim Kargbo who said he is the Head man of the community told his that the scene where the deceased coups was found belongs to on Jakartay.
On the 29th July 2023 whilst on duty he received a case and inquiry file from Calaba Town police station containing the statement of the accused person and on available witness he later obtained statements from Mr Ibrahim Kargbo the head man of the community
On the 2nd August 2023 in his presence and DPC 17897 Momoh D.K Dr Simeon Owiz Koroma conducted a postmortem examination during the cause the scene of crime officer conducted photographs and the cause of death certificate was handed over to the police and it has been in the custody of the police the cause of death certificate was produce and tendered in the court to formed part of the court records marked as exhibit B.
On the 3rd August 2023 himself and DPC 13174 Kargbo M.M contemporaneously interview the accused person in krio language which was recorded in English language at the conclusion of the statement it was read over and explained to the accused person in krio language which he admitted it to be true and correct by afflicting his right hand thumbprint witness by DPC 13174 Kargbo M.M and he signed as the recorder the statement of the accused person was produce and tendered in the court to formed part of the court records marked as exhibit C1-15
Whilst the accused person was making his statement he created an alibi because they discovered a multiple wounds on his body the accused said he involved in an accident the witness said they went to wash car and they met the woman at the scene they obtained statements from her in her statement she said she has been doing business at that location from 8am to 11am since she has been doing business there she never witness an accident of such she confirmed to the police that she recognized the accused person they reside at the same area, the witness based on what the accused person told them in his statement they went to the medical doctor who treated him the witness said he obtained statements from the doctor according to the doctor on the 28th July 2023 at around 3:30 the accused went to him together with his girlfriend whose name he cannot recalled and told him he involved in an accident and he want him to treats the wounds he sustained the witness said the doctor asked the accused why he didn’t go to the government hospital the accused said he has been wound for some time he went further to say that he does not want to treat him because he is not convinced that the wounds he sustained is from accident the doctor said because he has known the accused person for a long time he treated him the witness said the doctor and the accused person mentioned the lady who was present when he was treating him that prompt him to lead to his girlfriend himself together with the said investigator went to lower Allen Town where the accused identified a young lady as his girlfriend the witness said he obtained statement from the lady in her statement she identify the accused person as her boyfriend on the 28th July 2023 the accused went to her and told her that he is sick and told her to accompany him to the medical doctor.
On the 12th August 2025 himself and DPC 13174 Kargbo M.M further interview the accused person in respect of the an alleged case of murder the accused was caution and question in krio language which was recorded in English language at the conclusion of the statement it was read over and explained to the accused person which he admitted it to be true and correct by afflicting his right hand thumbprint witness by the said investigator whilst he signed as the recorder the charge statement was produce and tendered in the court to formed part of the court records.
Prosecution witness number four DPC 17987 Daniel Komba Momoh attached at the scientific support unit Waterloo police station
On the 28th July 2023 whilst on duty an alleged murder case was reported he was assigned together with a team of detective went to the scene of crime at Kelly Farm Waterloo on their arrival he examined the scene there was a human remains with human cloth evidence sustained on the remains of the deceased stainless knife was at the scene he took photographs of the scene the witness said the remains of the deceased was taken to the mortuary the witness said on the 23rd July 2023 they conducted a postmortem examination on his presence he concluded
The prosecution witnesses were cross-examined by Muctarr Rashid Esq.
Meanwhile Justice Fisher refused bail and sent the accused person to the male correctional facility in Freetown matter adjourned to the 18th July 2025.
