Mohamed Jagitay made another appearance before Justice Adrian Fisher at High Court No.1 Siaka Stevens Street in Freetown on a count charge to wit murder contrary to section 1 of the Offences Against the Persons Act of 1861 as repealed and replaced by section 1 (a) to the Schedule of the Abolition of the Death Penalty Act of 2022 Act No.6 of 2022.
According to the particulars of offence, on 28th July, 2023 in Freetown the accused murdered Ibrahim Jagitay.
When the charge was read and explained to the accused person, no plea taken.
The state prosecutor Musa Pious Sesay Jr. Esq. led in Prosecution witness number one Mohamed Alpha Jagitay. He recognized the deceased as his brother and the accused a friend to his later brother. The witness said prior to this time, he used to see the accused person at his residence. He recalled on 27th July, 2023 the accused came to their place of work at the bakery where he met himself and the deceased. the witness said he went to where they used to keep the flower and the accused and the deceased went to meet him and brother gave him money and told him that himself and the accused person were going somewhere around 9pm going to 10pm. The witness further told the court that the accused together with the deceased crossed the bridge and they entered inside a car and he went to sleep and that since then he didn’t see his brother, he concluded.
Prosecution witness number two Mohamed Alpha Jagitay a petty trader said he recognized the accused person as his elder brother son and the deceased as his elder sister’s son. He recall on 27th July, 2023 he was at his residence at Calaba Town. He said around 8pm going to 9pm he received a telephone call that they did not see the deceased since last night when they went together with the accused person. He said after receiving the information, he called and asked for the accused person to his sister and she told him that the accused is at home. The witness said he went there and met the accused person and asked him for the deceased. He added that the accused said himself and the deceased went to a bar and they dispatched around 4am. The witness said he took the accused person to Calaba Town police station and the police took the mobile phone of the accused and told him to go and find his son after that on Saturday around 2am his wife showed him a picture of the deceased lying dead on social media. The witness said upon that he went to Calaba Town police station and showed the picture of the deceased to the police and the police told him that the deceased was found on a Friday morning and he is at the hospital. He said they went to the hospital and identified the deceased. He observed that the deceased was stabbed all over his body. He said postmortem examination was done and they later took the remains of the deceased for burial. He furthered that he saw the hand of the accused was wounded but the accused told them he had an accident with motorbike the same Thursday night when he, the accused went out with the deceased. The witness added that the accused told him that a dispenser treated him. He said he had discussions with the dispenser and when he went to the accused and asked him if he only had wound on his hand, he answered in the affirmative. The witness said the accused’s father has land where the remains of the deceased was found and there was a gathered that there dispute over it, he concluded
The witness was cross examined by Muctarr Rashid Esq.
Meanwhile, Justice Adrian Fisher refused bail and sent the accused to the male correctional facility in Freetown and adjourned the matter to 27th June 2025.
