Twenty-one-years-old Ibrahim Barrie and Thirty-nine-years-old Sao Fefegulah, a farmer made another appearance before Magistrate Sahr Kekura of Pademba Road Court No.1 in Freetown.
They appeared on four count charges to wit conspiracy to commit a felony contrary to law, house breaking and larceny contrary to section 26 (1) of the Larceny Act 1916.
For receiving stolen goods contrary to section 33 (1) of the Larceny Act 1916 and was held for fraudulent conversion.
According to the particulars of offence on Friday 25th August 2023 at Baoma oil Mill Village, Kandu Leppiama Chiefdom Kenema District the Eastern region of Freetown with intent to defraud conspired together and with other persons unknown to defraud Alusine Mohamed Conteh four carats and fifteen percent 4,15%) diamond valued four hundred and seventy seven thousand two hundred and fifty Leones(477,250).
Count two further stated that on the same date and place, the accused persons
with intent to steal and broke and entered into the dwelling house of Moses Brima Conteh and stole therein four carats fifteen percent diamond, eighty six percent diamond, seventy three percent diamond and one carats fifty five percent diamond all to the total value of five hundred and eleven thousand five hundred and eighty nine Leones (511,589 ) property of Alusine Mohamed Conteh whilst in the custody of Moses Brima Conteh.
Count three further stated that the second accused person did receive one four carats fifteen percent diamond valued four hundred and seventy seven thousand two hundred and fifty Leones(477,250) from Ibrahim Barrie knowing same to have been stolen.
Count four further stated that on the same date and place, the second accused person fraudulently converted to his own use or benefit certain property.
The four carats fifteen percent diamond values at four hundred and seventy seven thousand two hundred and fifty Leones(477,250) from Ibrahim Barrie for the purpose of sale property of Alusine Mohamed Conteh.
When the charge was read and explained to the accused person, no plea taken.
Assistant Superintendent of police Ibrahim S Mansaray was lead prosecution and witness number four was Sergeant 10170 Abdul Mohamed Kamara attached to the anti-fraud unit at the Criminal Investigation Department on Pademba Road.
He said he knew the complainant and the accused persons in this matter on the 7th October 2023 and on duty a transfer case and inquiry files from CID to eastern region in Kenema district. The case entails nine statements including the voluntary caution statement from the accused persons and since then it was in the custody of the police.
The said statements were produced and tendered in court to form part of the court records.
On the 18th and 23rd October 2023 himself together with DPC 18591 Kamara H.N obtained additional voluntary caution statements from the accused persons separately and at the conclusion of the statement it was read over and explained to the accused persons separately which they admitted to it to be true and correct by afflicting their right hand thumbprint before DPC DPC 18591 Kamara H.N and Kamara signed as the recorder and the said statement has been in the custody of the police which was produced and tendered in court to form part of the court records.
On the 28th October himself together with the said investigator charged the accused separately; the first accused was charged with the offence conspiracy to commit a felony and house breaking and larceny.
The second accused was charged with conspiracy to commit a felony, for receiving stolen goods and fraudulent conversion and at the conclusion of the charge statement it was read over and explained to the accused persons.
