Sheku Sesay a businessman made another appearance before Magistrate John Manso Fornah of Pademba Road Court No.2 in Freetown on two count charges to wit fraudulent conversion contrary to section 20 (iv) (b) of the Larceny Act 1916 and obtaining money by false pretences contrary to section 32 (i) of the Larceny Act 1916.
According to the particulars of offence, sometimes between February and July 2020 at Metchem Junction Funkia in the western area of Freetown, fraudulently converted to his own use or benefit certain property that is to say, the sum of eighty thousand leones (80,000) entrusted to him by Morlai Turay for the purpose of buying board in Kailahun district.
Count two further stated that on the same date and place, the defendant with intent to defraud, obtained the sum of eighty thousand leones (Le80,000) from Morlai Turay by falsely pretending that he is going to supply him quantity of boards knowing same to be false.
When the charge was read and explained to the defendant, no plea was taken.
The prosecuting counsel J.T Conteh Esq. closed his case and the file was withdrawn for ruling.
Magistrate Fornah delivering his judgment said he considered the charges as well as the particulars of offence proffered against the defendant by the complainant herein through his lawyer J.T Conteh and he also considered the testimonies of witnesses of complainant and that their testimonies corroborated with each other. He said he further considered the testimony of the defendant herein who denied the allegations against him proffered by the complainant however the matter commenced by way of a preliminary investigation and having gone through the entire evidence against the defendant herein, he was satisfied that the said evidence of the complainant and his witness raised a primal facie case to be answered by the defendant in the high court, he therefore committed the defendant to the High Court to stand trial.
Counsel for the defendant renewed and adopted his previous bail applications on behalf of the defendant.
Meanwhile, Magistrate Fornah admitted him to bail in the sum of ninety thousand leones and a surety in like sum surety and must be a senior citizen resident in Freetown to produce valid identity card depicting his or her address in Freetown to be gainfully employed with proof and bail to be approved by the Deputy assistant Registrar.
